Permitted Use of (Hastings Council) Greater Port Macquarie Images

This agreement is between Hastings Council and the User referred to in Item I of the following Schedule (Download Application Form).

Hastings Council and the User agree to use the material under the following Terms and Conditions:

1. The User shall only use the material for the permitted use in the territory referred to in Item 4 of the Schedule and where applicable for the period of time referred to in Item 3 of the Schedule.

2. The User shall not make or allow others to make a copy of the material other than for the permitted use.

3. In authorising the reproduction of material Hastings Council does not surrender its own right to reproduce an image, or grant permission for others to do so.

4. Applicants are cautioned that in most cases Hastings Council is the owner of the physical object copyright only, and may not own copyright or other intellectual property rights.

5. The User hereby releases, discharges and holds harmless Council from and against all actions, proceedings, claims, suits and demands arising from the User's use of the Material and shall indemnify Hastings Council from and against all costs, damages and expenses (including legal expenses as between solicitor and own client) which have or may be incurred by Hastings Council as a result of the User's use of the Material in any manner whatsoever other than as permitted by the Authorisation.

6. The User shall return the material to Hastings Council by the date specified in Item 5 of the Schedule.

7. A credit line, as specified by the Council, must appear in close proximity to the reproduction or in a special section devoted to acknowledgments.
